1. Acceptance of Terms
By accessing or using SRExpert ("the Service"), operated by Privum Lda ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
SRExpert is a Kubernetes management platform that provides workload management, monitoring, security scanning, compliance checking, Helm chart management, smart alerting, and AI-powered operations assistance for Kubernetes clusters. The platform integrates with third-party AI providers to deliver intelligent operations capabilities.
3. Account Registration
You must create an account to use certain features of SRExpert. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the service for any illegal purposes
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service or its infrastructure
- Reverse engineer, decompile, or disassemble the software
- Use the service to transmit malware, harmful code, or unauthorized data
- Use AI-generated outputs to make decisions without human review in safety-critical systems
- Resell, redistribute, or sublicense the service without written authorization
5. AI-Powered Features — Disclaimer
SRExpert integrates AI capabilities powered by third-party providers, including but not limited to Anthropic (Claude), Alibaba Cloud (Qwen), OpenAI (ChatGPT), Google (Gemini), and DeepSeek. By using these features, you acknowledge and agree that:
- AI outputs are informational only. AI-generated responses, recommendations, root cause analyses, and remediation suggestions are provided as-is and should not be treated as definitive or guaranteed solutions.
- No guarantee of accuracy. AI models may produce incorrect, incomplete, or outdated information. You are solely responsible for validating and reviewing any AI-generated output before acting on it.
- Third-party provider terms apply. Your use of AI features is also subject to the terms and policies of the respective AI providers. We do not control and are not responsible for the outputs generated by these third-party models.
- No liability for AI actions. Privum Lda shall not be held liable for any damages, losses, downtime, data loss, security incidents, or any other consequences resulting from actions taken based on AI-generated recommendations or outputs.
- Data handling. Queries sent to AI providers may be processed on external infrastructure. Do not submit sensitive credentials, secrets, or personally identifiable information through AI features. We anonymize and strip sensitive data where possible, but cannot guarantee complete sanitization.
- Human oversight required. AI features are designed to assist and augment human decision-making, not to replace it. Critical infrastructure decisions should always involve qualified human review.
6. Subscription and Billing
Some features require a paid subscription. You agree to pay all applicable fees. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are available within 14 days of purchase as outlined in our refund policy.
7. Data and Privacy
Your use of SRExpert is also governed by our Privacy Policy. By using the service, you consent to the collection and use of information as described in our Privacy Policy. You retain ownership of all data you provide to the platform, including cluster metadata and configuration data.
8. Intellectual Property
SRExpert and its original content, features, and functionality are owned by Privum Lda and are protected by international copyright, trademark, and other intellectual property laws. The SRExpert name, logo, and branding are trademarks of Privum Lda.
9. Limitation of Liability
To the maximum extent permitted by law, Privum Lda shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. This includes, without limitation, damages arising from:
- AI-generated recommendations or outputs
- Service interruptions or downtime
- Loss of data or unauthorized access
- Actions taken based on monitoring, alerting, or compliance data
- Integration with third-party tools and services
Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
10. Service Level and Availability
We strive to maintain high availability of the service but do not guarantee uninterrupted access. Scheduled maintenance, updates, and unforeseen circumstances may cause temporary disruptions. We will make reasonable efforts to notify you of planned downtime in advance.
11. Service Modifications
We reserve the right to modify, update, or discontinue features of the service at any time. For material changes that affect your use, we will provide reasonable notice. We shall not be liable to you or any third party for any modification or discontinuation.
12. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice, for any breach of these Terms. Upon termination, you may request export of your data within 30 days. After this period, we may delete your data.
13. Indemnification
You agree to indemnify, defend, and hold harmless Privum Lda and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes shall be submitted to the competent courts of Porto, Portugal.
15. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new "Last updated" date. Your continued use of the service after changes constitutes acceptance of the updated Terms.
